As expected, Samsung Electronics have made the move to seek a legal ban on sales of iPhone 4S in Australia and Japan. The Korean manufacturer are claiming copyright patent infringement by Apple and have already saught the same ban in Italy and France. The move comes shortly after an Australian court forced a temporary ban on Samsung's Galaxy Tab 10.1 after a similar lawsuit by Apple. As we reported recently, Apple and Samsung are in major dispute in a bitter legal battle over the sales of similar smartphones and tablet PCs. Samsung are quoted as saying in a statement;
"Apple has continued to violate our patent rights and free ride on our technology," Samsung said in a statement. "We will no longer stand idly by and will steadfastly protect our intellectual property." Losing ground?
In the battle between the two technology giants, Apple seem to be gaining the legal advantage, certainly in the US. A judge in America last week ruled that Samsung's tablets did infringe patents owned by Apple (as long as they proved the validity of the patents with documentation) that will prevent the sale of the Galaxy Tab. Samsung have already appealed a ban in Australia and are likely to follow in the U.S. Apple already won the battle with Samsung in Germany where the Galaxy Tab 10.1 can't legally be sold. But Samsung aren't having as much luck with Dutch courts. Last Friday a plea to stop Apple selling some of their products in Netherlands was rejected outright.
