Why It COULD Be Them

Well, there's this detail from the LEGO set...

The LEGO set seems to suggest the truck at the centre of the scene is carrying DODC (Department Of Damage Control?) items - probably recovered Chitauri tech from the New York Incident - which could suggest that The Tinkerer and Vulture might have an inside man. How else would they gain access?

And of course, there's also the set photos of Tyne Daly and Gary Weeks wearing name-badges suggesting they work for the Department Of Damage Control, which would fit.

Why It Might Not Be

That wouldn't really class as an important enough character reveal to be hidden by LEGO, surely? Particularly not when the DODC crates weren't hidden.
