1. The Tinkerer
Why It COULD Be Him
We already have a fairly established idea that The Tinkerer and Vulture will be working together, and that the former will use abandoned (and seemingly stolen) Chitauri tech to make the latter's wing suit, so he's pretty much the most obvious missing part of the picture.
Obviosuly, that's complicated a little by the fact that Vulture HAS his suit and the DODC crates aren't yet opened, but if you're expecting narrative fidelity from LEGO you're looking in the wrong place.
Why It Might Not Be
There's nothing in either the character's backstory in the comics or the casting of Michael Chernus that suggests he'd be a hands-on sort of villain who'd get his hands dirty driving a truck in the firing line. Even if LEGO have taken some liberties, you'd think his character would be more likely to appear in some sort of laboratory set.
