6. Mutants Already In The MCU

The introduction of the Maximoff twins in the post-credit scene of The Winter Soldier was awkward to say the least. The majority of fans knew them as the son and daughter of Erik Lehnsherr, more affectionately known as Magneto, and watching the writing staff skirt around their mutant origin was a sight to behold.

But since the mentioning of this fact would have no doubt resulted in legal issues between Marvel and Fox, Kevin Feige decided to change things up a bit. The twins were referred to as the 'miracles' who survived Hydra's experimentation at the hands of Baron von Strucker. And as such, both Pietro's superspeed and Wanda's psychokinesis were explained as being born from a prolonged exposure to the Mind Stone still encased in Loki's Scepter.

Phase 4 is set to be a bit different though. Since Disney now owns 20th Century Fox and the right to categorize characters as mutants, steps will have to be taken to bring older characters like Wanda Maximoff more in line with her mutant counterparts. And while this is usually achieved through retconning, Marvel Studios have worked incredibly hard to achieve a tried and tested cinematic universe that successfully meshed our favorite movies together. Considering that the eradication of even a tiny segment of an already established backstory is sure to cause conflict between fans, retconning is likely out of the question.

In fact, it was Wanda's connection to the Mind Stone which drove her into Vision's arms and ultimately led to her being able to destroy the stone towards the end of Avengers: Infinity War. So taking this from her origins would cause far more problems than it would solve, which is why Marvel has come up with a better plan.
