Why It COULD Be Him

Ever since (according to Bleeding Cool at least), Sony employees started taking a huge interest in Nightwatch (“buying up any and all comic books that feature the character”), the question of his potential involvement in the new Spidey film universe has hung pretty ominously over the project.

Sure, it's not the most substantial evidence, but the idea of having another hero (or anti-hero) operating in Spider-Man's New York would be a welcome new direction, not least because the 80s-introduced Nightwatch is awesome. Perhaps he's the one driving the truck, which might go some way to explaining why both Spider-Man and Iron Man AND Vulture appear to be pursuing.

Why It Might Not Be

It would be a major departure from the character's comic origins (which isn't necessarily a bad thing, given how odd it is and how it might not translate to the big screen) and it's far more likely we'd see Nightwatch appear in a Sony expansion of the Spider-Man universe whenever they kick back off.
