This special order was cited by Inspector Sloane as allowing Starfleet to neutralise threats to Deep Space Nine by any means necessary. That gives the team a wide range of authority, yet there is a chance that it is both entirely fabricated or older than the Federation itself.
Section 31 was part of the original Federation charter, existing outside of the jurisdiction of Starfleet, allowing them a lot of leeway in the methods that they used to protect the citizens of the Alpha Quadrant. However, the vagueness of the wording here allows them to do whatever it is that they want. This includes building their own space station and fleet as well.
By the time that Doctor Bashir encounters them, they are a shadowy organisation that exists between the cracks. In Captain Pike's day, they were a military force to be reckoned with before they were overcome by Control. Unfortunately, the nature of this law allows Control to extend throughout the entire organisation, separate as it is from the rest of Starfleet.
It is something of an open secret that the organisation exists. When questioned by Sisko, Starfleet can neither confirm nor deny their existence. Any means necessary, in this case, means having a subsection who can do whatever they want, for as long as they want, without any fear of oversight.
