Why Doctor Who Banned The Daleks
That agreement came only a month after the BBC's statement, so the two parties managed to work out a deal. The terms of that deal were never made public, but it seems they may have expired, or have stipulations that Chibnall might prefer to avoid. Even if they haven't, and the BBC still retains the right to use them, Chibnall has been vocal in his opposition to feature them as a main antagonist in the regular series episodes.
All of that being said, a Dalek did appear in the only episode to air in 2019. In the New Year's Day special episode, "Resolution," the 13th Doctor did come in contact with a Dalek, and things didn't go well for anybody, thanks to ending on a cliffhanger.
The Doctor is set to return for another Holiday Special in 2020, and Chibnall wrote in a statement released by the BBC, where he said the following about the Doctor and the Daleks:
"We can’t leave the Doctor there! On that cliffhanger! Well, we did. But rest assured, the Doctor and her friends will be back for a one-off extended special around Christmas and New Year. (I don’t know when they’re going to put it on yet, otherwise, we’d tell you!). There will be Daleks. There will be exterminations. Thrills, laughter, tears. You know. The usual. See you at the end of the year."
So, there you have it. Daleks will return, but only in a follow-up special to another special. The regular series episodes that should (hopefully) return in 2021 may avoid Daleks altogether, but only time will tell what Chibnall will do with the series and its greatest villain.
