Vince McMahon & Top WWE Management DESTROYED EVIDENCE In Ongoing Trial (WWE News)
Vince McMahon and Nick Khan ruled to have destroyed evidence in the ongoing merger lawsuit.
The ongoing WWE merger lawsuit has had a major development, as Vice Chancellor J. Travis Laster has said disgraced former WWE Chairman Vince McMahon and current WWE President Nick Khan destroyed evidence. This case has been brought by shareholders alleging that McMahon orchestrated a deal with Ari Emanuel and Endeavor to merge with UFC and form TKO, rather than fairly explore options from other potential bidders.
Brandon Thurston of Wrestlenomics and POST Wrestling was the first to break this news, reporting that McMahon, Kahn, and three others - WWE Chief Content Officer Paul Levesque, former WWE CEO Stephanie McMahon, and former WWE COO Brad Blum - all used Signal's auto-delete function, which deleted messages that they had a legal duty to preserve. For those unaware, Signal is a secure messaging app.
As a result of this decision from Laster, five damaging facts against the defendants in this case will now be treated as "presumptively true". The defendants are Vince McMahon, Nick Khan, Paul Levesque, and former WWE Co-Presidents and board members George Barrios and Michelle Wilson, and this latest development is a major setback for those names.
The five things that will now be treated as fact are:
- TKO CEO Ari Emanuel promised to give Vince McMahon a continued role in any post-merger company after McMahon's decision-making on the merger was influenced by a transaction.
- Ari Emanuel's offer of indemnification and other legal support regarding pending federal investigations into Vince McMahon's alleged misconduct also influenced McMahon's decision-making on the merger.
- Vince McMahon opted to pursue a deal with Endeavor in 2022 before the company had initiated a strategic review process.
- Nick Khan communicated with Ari Emanuel between August 2022 and December 2022 in regards to making a deal between WWE and Endeavor.
- Vince McMahon and Nick Khan worked with advisement firm Raine to push through a deal with Endeavor and to steer away from other potential bidders.
While those five things are now to be treated as fact, the plaintiffs requested two further items to be presumed as fact, but they were rejected by Vice Chancellor Laster. They were:
- Vince McMahon received a non-ratable benefit from the merger in the form of a continued role at TKO.
- Nick Khan knew about Vince McMahon's negotiations with Endeavor relating to a potential merger in 2022.
In the majority of civil lawsuits, the party making allegations has to prove their claims. With this latest development, it's now down to the defendants to disprove the five items that have now been made facts with "clear and convincing evidence."
The trial for this case is currently scheduled to take place between June 8 and 12.
