7. X-Men Has Already Done It

As if directly competing with another comic book movie pitting two heroes against one another, Marvel also have to get around the fact that the Civil War storyline has already been done, several times, in the X-Men movie franchise.

That movie universe started from the same point: human fears about insignificance and collateral damage leading to the debating of mutant registration. In reaction, Magneto raised his army, willing to adopt whatever behaviour necessary to stop it from happening (ok, so his megalomania muddied the waters a bit, but his intentions were comparable to Cap's). 

X-Men's version of the same story worked precisely because of its depth; Magneto's past and the allusions to Nazi Germany played their parts in adding complexity and making it relatable on a human level. In contrast, Civil War is more like a political debate for Gods, and humanising it too much will rob the MCU of its commitment to being super-real.
