2. It Doesn't Necessarily Break Robert Downey, Jr's Contract
One of the biggest reasons you're probably thinking this is all hokum - desperate theorising to keep hope that the best Avenger stays alive (yes, Cap is my fav, what of it?) - will be that Tony Stark can't die because Robert Downey, Jr.'s lined up for more Marvel movies. This has been a key part of Marvel's struggle with death fake-outs; you know Loki and Nick Fury are just playing games because Hiddleston and Jackson have many more films left, while Quicksilver was obviously not going to make it out of Age Of Ultron alive because Aaron Taylor Johnson was the only hero to not be locked in for an upcoming movie. However, while this factor means most members of the Avengers are indeed safe in Civil War, there is actually a distinct possibility this is actually RDJ's last contracted film. What we know is this: he extended his initial deal to star in Avengers 2 and 3, then when Civil War was on the table entered negotiations to star in that. Now, many assume these discussions saw the movie as an addition to what was already agreed on, but what if it was actually an alteration; that he agreed to do Captain America 3 instead of Avengers 3? There is nothing to really suggest this isn't the case, and the fact the new deal hasn't been explicitly stated in the same way as the nine-movie deal some of the other prominent stars have suggests there's something tricksy afoot.
