3. He's In Avengers 4

It's a fairly straight-forward point, but unless Marvel have cunningly gone to extreme lengths to set up entirely fake shooting days with Robert Downey Jr, he's definitely in Avengers 4.

Quite what he's up to remains to be seen, but he definitely seems to be involved in the mooted time travel element (mostly because his hair suggests he's still the older version of the character rather than the clearly Battle Of New York era Cap). So, in other words, killing him off would create some almighty problems on that front.

Now, obviously there are other ways (like more travel) of undoing his death, but using it twice in the space of a single movie would fit the "frivolous overuse" concerns already brought up and would devalue using it as a mechanism to go back for Cap (or whatever the real reason turns out to be).
