17. Why Would Retrieving A WMD Be A Crime?

Now, I can understand why sending a sanctioned black ops team into another country to retrieve a Weapon Of Mass Destruction from the government might be classed as a criminal act by that government. I can perhaps also understand why the US government would be upset with it, since it would presumably fray international relations...

...But why the hell is the mission to retrieve the WMD from the dangerous group in Berlin (probably terrorists) deemed criminal by the US government (that's the inference of the agent's spiel, not that it will be frowned upon by the German government).

Are they all so committed to possession being a major part of the law that they'd prefer to allow an interior threat to have a stolen EMP device capable of levelling cities? And why would a secret US government agency have to set up this heist in contradiction of its own government?!
