When Bojack and Mr. Peanutbutter engaged in a massive egotistical competition to win over Diane, mostly by buying more and more expensive things, Bojack bought the restaurant, Elefante. Afterward he never really interacted with the restaurant, until he accidentally fired the main waiter who took most of the staff with him.

Bojack and Princess Carolyn tried their hardest to ensure a decent review from a critic who happened to be there that night, promoting the only staff member left to the head chef, and even recruiting some of the other dining guests to be waiters. The critic was still unpleased, even with the food coming out decent, assumedly ending the restaurant.

But in season five, Elefante is seen to still be running, even keeping some of the staff members from that night, yet the whole restaurant shouldn't be operational. Even if the first critic was just a small online critic with no real power over the realm of food, surely one with power or some sort of real inspector would have show up and shut the place down. Todd's ex-girlfriend, who is an inspector, even says as much during the same episode, and somehow the iconic restaurant lives on.
