Making A Murderer: Where Are They Now?

2. Brendan Dassey Is Repeatedly Failed By The Legal System

To claim that Brendan Dassey was in any way involved in Teresa Halbach’s murder involves a major stretch of the imagination. Nonetheless, just like his uncle, he remains in prison. At the moment, he is incarcerated in Oshkosh Correctional Institution, and he will not be eligible for parole until 2048, when he will be 59 years old.

In June 2018, Dassey’s legal team sought certiorari, or in layman’s terms, a judicial review of the lower court's decision about his case. Justices scheduled a conference, and Dassey's request was placed on the agenda. It was at this meeting that they were due to decide whether his case would be heard, but for undisclosed reasons, it was removed from the topics of discussion and never rescheduled. By the end of the month, certiorari had been denied, which was an enormous blow for the 31-year-old and his legal team.

Taking a different approach, Dassey's lawyers and supporters also tried to convince Wisconsin Governor Tony Evers to commute his sentence. In December 2019, Evers publicly refused to consider his case. They remain hopeful that he will change his mind though, and continue to put pressure on him. After all, a commutation could provide Dassey with his long-awaited key to freedom.
