3. Blaming Him For The Release Of The Amazo Virus - Justice League (Vol. 2) #36-39
Some time after the Justice League allowed Lex Luthor into its fold, a mysterious virus began to infect the citizens of the world. When told this, Luthor appeared deeply suspicious, before revealing an almost obvious truth: he'd created the disease in the first place.
After beating him up a little, Lex explains. As it turns out, the Amazo Virus was designed to only affect Kryptonians, which is why Luthor was horrified to see it affecting regular humans. Not wanting to be responsible for a modern age black plague, the reformed villain begins to work on a cure, while continually berated by Superman all the way.
Though it's entirely fair that Supes is mad about the whole thing, it has to be remembered that he made this virus years before he reformed, and so it doesn't reflect on his current moral standing.
Thus, although it's messed up Lex made a personalised poison to take out the Man of Steel, it's also worth remembering that Superman agreed to put all the times the pair had fought aside when Luthor joined the Justice League. And so, it seems entirely redundant to decide he's still a supervillain for a plot he made at the height of his personal depravity.
