Obviously, Heath Ledger's death changed the plans for The Joker's possible involvement in a sequel to The Dark Knight but it would be wrong to suggest that the rumours that he would have appeared on trial in the final part of the trilogy. That seems to be a misreading of a rumour relating to an early version of The Dark Knight (and a possible alternate third film), which David S Goyer worked on.

Apparently, Goyer planned to have a scene set before Harvey Dent is transformed into Two-Face that saw The Joker on trial after he engineered his own arrest after a rampage. The first film would have ended with his capture, while the third would have seen the court sequences, pitting the Joker's chaotic spirit in direct battle with Dent's unambiguous moral integrity.

And as a crowning moment, it would have been the Joker who scarred Dent and created Two-Face, which would have made for quite the moment too. Whether it would have been better than what we got in the final The Dark Knight remains to be seen, but it would still definitely have been a great spectacle.
