8. The Mutant Fence Sitting

The most interesting element of the conflict in Civil War is that it's not entirely binary: there are rogue elements (more of which soon) and those who choose to abstain, despite the implications of the Superhero Registration Act to their very existence. Those fence-sitters are the mutants, under Charles Xavier's typically cautious leadership, who are already decimated by their own extinction level event just before Civil War. Unfortunately, unless Fox have come to the table with Marvel for some seriously secretive negotiations, the X-Men are off limits, and it's too early in the Inhumans' timeline to have them suddenly appear and express apathy. Because who the hell would care? So, there won't be the added element to shake things up. But then, that's probably for the best, because it's too much of a diversion for a film that will have to come in at under 2 hours. The Alternative So will anyone else abstain? There's a distinct possibility that the Russos will use Thor's absence as an excuse to have him be the fence-sitter: after all, he's a God, rather than a simple superhero, so it wouldn't even be semantically correct to register him as one.
